Terms of service

1. The agreement

These terms are an agreement between Sayan Bhattacharya, trading as Triagic ("Triagic", "we", "us") and the business that creates a Triagicaccount ("Customer", "you"). They cover the website, the customer portal, hosted forms, the desktop app and everything else we provide (the "Service"). Our Privacy Policy and Data Processing Addendum form part of these terms.

By creating an account, you accept these terms on behalf of your business and confirm you have authority to do so. The Service is for business use only. You must be 18 or older to use it.

2. Accounts and members

You are responsible for your account, the members you invite, and everything done under them. Keep passwords and API keys safe and tell us at hello@triagic.com if you suspect unauthorized access. Each seat is for one named person and may not be shared.

3. Trial, plans and billing

  • New accounts get a free trial. When it ends, the desktop app locks until you subscribe. Nothing is deleted.
  • Paid plans and add-ons are billed monthly per seat, in advance, in Indian rupees through Razorpay, at the prices on our pricing page when you subscribe. Prices include no taxes unless stated; applicable taxes such as GST are added.
  • Subscriptions renew automatically each month until cancelled. You can cancel at any time and keep access until the end of the period you paid for. Payments are non-refundable, including for partly used months, except where the law requires a refund.
  • Adding seats takes effect immediately. We may change prices with at least 30 days' notice by email, effective at your next renewal.
  • If a payment fails, we may suspend paid features until it succeeds.
  • AI usage is billed by your AI provider under your own agreement with it. We do not resell or mark up AI usage, and we are not responsible for those charges.

4. Your data

You own everything you and your members put into the Service, including form submissions and email threads from your own customers ("Customer Content"). You give us permission to host, process and transmit Customer Content only to provide the Service to you. We do not use Customer Content to train AI models or for any other purpose.

You are responsible for having the right to give us Customer Content, and for telling your own customers, in your privacy notice, that you use Triagic to handle their requests.

5. Your systems, your AI provider

Triagic connects to systems you choose (databases, cloud accounts, observability and ticketing tools) using credentials you provide, and to an AI provider using your own API key. You are responsible for those credentials and the access they grant. We recommend read-only credentials and design the product around them, but the permissions a credential has are set by you. Your agreements with those third parties govern your use of them.

6. AI output

Investigations, suggested replies, summaries and other output are generated by AI models and can be wrong or incomplete. Review output before acting on it or sending it to anyone. You are responsible for decisions you make and messages you send based on it.

7. Acceptable use

You will not, and will not let anyone else:

  • use the Service to break any law, or to infringe anyone's rights;
  • connect it to systems or data you are not authorized to access;
  • send spam or unsolicited email through hosted forms or email features;
  • upload malware, or probe, overload or disrupt the Service or its infrastructure;
  • bypass seat counts, license checks or usage limits;
  • resell the Service, or copy, reverse engineer or decompile it except where the law allows despite this restriction;
  • use it to build a competing product.

We may suspend accounts that break these rules. Where we reasonably can, we will warn you first and give you a chance to fix it.

8. Our property

We own the Service, the desktop app and all related software, content and trademarks. We grant you a non-exclusive, non-transferable right to use them during your subscription, for your internal business purposes. If you send us feedback, we may use it without obligation to you.

9. Availability and changes

We work to keep the Service available but do not promise any particular uptime. We may change, add or remove features. If we remove a feature you are paying for, we will tell you in advance. Support is by email at hello@triagic.com on a best-effort basis.

10. Ending the agreement

You can stop using the Service and cancel at any time. We can end these terms or suspend your account if you materially breach them and do not fix the breach within 14 days of notice, or immediately if the breach threatens the Service, other customers or the law. We can also end the Service for everyone with 60 days' notice, refunding any prepaid fees for the time after it ends.

When the agreement ends, your right to use the Service ends. You can ask us to delete your data at any time; the Privacy Policy explains how. Sections 4, 6, 8, 11, 12, 13 and 14 survive.

11. Disclaimer

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused. Each party's total liability under these terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. If you have paid nothing, our total liability is limited to INR 8,000.

These limits do not apply to your payment obligations, your breach of section 7, or liability the law does not allow to be limited.

13. Indemnity

You will defend and compensate us against third-party claims arising from Customer Content, your connected systems, or your breach of section 7.

14. Law and disputes

These terms are governed by the laws of India. The courts of Kolkata, West Bengal have exclusive jurisdiction over any dispute arising from them. Before going to court, each party will try to resolve the dispute by writing to the other and negotiating in good faith for 30 days.

15. General

  • We may update these terms. We will post the new version here and email account owners at least 30 days before a material change takes effect. Continuing to use the Service after that means you accept it.
  • You may not assign these terms without our written consent. We may assign them to a successor, including a company we form to run Triagic.
  • Neither party is liable for delays caused by events beyond its reasonable control.
  • If a provision is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver of it.
  • These terms are the entire agreement between us about the Service and replace any earlier understanding.
